    On 21 April 2014, the USEPA and the Corps of Engineers (Corps) are publishing a Notice of Availability and Public Comment to announce the availability of an interpretive rule regarding the applicability of the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA) for discharges of dredged and/or fill material associated with certain agricultural conservation practices based on the Natural Resources Conservation Service (NRCS) conservation practice standards that are designed and implemented to protect and enhance water quality. The interpretive rule was effective on April 03, 2014.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that, The Doe Run Resources Corporation d/b/a Doe Run, ATTN: Mr. Mark Cummings, PO Box 500, Viburnum, Missouri 65566, has requested authorization for the placement of dredged and fill material in waters of the United States associated with the construction of a new mine tailings impoundment. The proposed project is located in 25,111 linear feet of Lick Creek and tributaries, in sections 13, 14, 23, 24, and 26, T. 33 N., R. 2 W., northeast of Bunker, Reynolds County, Missouri.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Craig Woodcock, Ben E. Keith Company, 601 E. 7th Street, Fort Worth, Texas 76102, has requested authorization for the placement of dredged and fill material in wetlands and waters of the United States associated with the construction of a food service products warehouse distribution facility on a site that is approximately 70 acres and includes truck and rail access. The proposed project would impact (fill) approximately 4.3 acres of scrub-shrub wetlands adjacent to Stark Bend and 967 linear feet of a jurisdictional ephemeral channel that connects an intermittent stream on the east side of the property to wetlands on the west side of the property. Water flow exits Stark Bend and enters the project area wetlands and the jurisdictional ephemeral channel which then flows eastward into a north-south running intermittent stream located on the east side of the property. This intermittent stream flows south through unnamed intermittent channels where it enters Faulkner Lake, which is an oxbow lake. Water exits Faulkner Lake through the main Faulkner Lake channel where it flows southward into Horseshoe Lake, Scott Bayou, and Old River Lake, all remnant oxbow lakes of the Arkansas River. Exiting Old River Lake, water then flows through the main drainage channel into the Arkansas River. The proposed project is located immediately south of Stark Bend, in the SE 1/4 of section 27, T. 2 N., R. 11 W., North Little Rock, Pulaski County, Arkansas.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Doug Bagby, City of Poplar Bluff, 101 Oak Street, Poplar Bluff, Missouri 63901, has requested authorization for the placement of dredged and fill material in waters of the United States associated with the construction of Shelby Road Phase II. The proposed project is located in wetlands and Pike Creek, in sections 4, 5, and 9, T. 24 N., R. 6 E., Poplar Bluff, Butler County, Missouri.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Edward L. Baker, Route 1, Box 34E, Ellsinore, Missouri 63937, has requested authorization for the placement of dredged and fill material in waters of the United States associated with constructing a 56-foot-tall dam to create a 50-acre lake, to be known as Ed Baker lake #2. The proposed lake would impact approximately 2,733 linear feet of stream. The construction of the proposed dam would impact 324 linear feet of stream from the placement of 288 cubic yards of material below the ordinary high water mark and 2,409 linear feet of streambed due to inundation. The proposed project is located in an unnamed tributary to North Prong Beaverdam Creek, in the NW ¼ of section 14, T. 25 N., R. 3 E., east of Grandin, Carter County, Missouri.
