    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that, Arkansas Department of Transportation, PO Box 2261, Little Rock, Arkansas 72203-2261, has requested authorization for work, including the placement of dredged and fill material, in waters of the United States associated with constructing a new highway that will connect the Springdale Northern Bypass to the Northwest Arkansas National Airport. The proposed project will cross nine streams and two wetlands and is located in sections 4, 9, 14, 15, 16, and 23, T. 18 N., R. 31 W., Benton County, Arkansas. The project purpose is to improve access from the future Springdale Northern Bypass (SNB) to the Northwest Arkansas National Airport (XNA). As the population increases in Northwest Arkansas, demand at XNA has increased for both passenger and freight flights. The proposed project would provide an improved connection between XNA and the SNB that reduces congestion and increases reliability.

    Pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S. Code 403), notice is hereby given that Hillard’s Farms, PO Box 108, Ozark, Arkansas 72949-0108, has requested authorization for work in waters of the United States associated with a time extension of an existing permit that authorizes the removal of sand and gravel from a dike field along the Arkansas River. The project purpose is to remove sand and gravel for processing and subsequent individual and commercial use. Removal of the material deposited by the river will be transported by dump truck for processing and subsequent sale.

    Pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S. Code 403), notice is hereby given that, Mr. Michael McCarthy, Lentz Sand & Gravel, LLC, 185 Sardis Road, Morrilton, Arkansas 72110, has requested authorization for work in waters of the United States associated with the continuation of their commercial sand and gravel removal operations. Currently, Lentz Sand & Gravel, LLC (Lentz) is authorized to remove sand landward of and in a dike field. The sand and gravel removal operation is located in the Arkansas River, between Navigation Miles 175.4 and 176.4 on the right descending bank, sections 25, 26, and 35, T. 6 N., R. 17 W., in Conway County, Arkansas.

  • Beta SDAM

    The U.S. Army Corps of Engineers (Corps) Baltimore, Buffalo, Charleston, Chicago, Detroit, Fort Worth, Galveston, Huntington, Jacksonville, Kansas City, Little Rock, Louisville, Memphis, Mobile, Nashville, New England, New Orleans, New York, Norfolk, Philadelphia, Pittsburgh, Savannah, St. Louis, Tulsa, Vicksburg, and Wilmington Districts, and the U.S. Environmental Protection Agency (EPA), Regions 1, 2, 3, 4, 5, 6, and 7 jointly announce the availability of the Beta Streamflow Duration Assessment Methods (SDAM) for the Northeast and Southeast (dated April 12, 2023). The methods are rapid assessment tools to help distinguish between ephemeral, intermittent, and perennial streamflow at the reach scale for the Northeast and Southeast SDAM Regions. The beta SDAMs may help provide technical guidance for identifying waters that may be subject to regulatory jurisdiction under Section 404 of the Clean Water Act; however, these methods do not alter or change the definition of “Waters of the U.S.”

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Missouri Department of Transportation (MoDOT), 601 West Main Street, Jefferson City, Missouri 65101, in cooperation with Federal Highway Administration (FHWA) has requested authorization for the discharge of fill material in waters of the United States associated with the Phase 1B and Phase 2 upgrade of U.S. Route 67 (R67) to create Interstate 57 (I-57). The proposed project will discharge fill material below the Ordinary High Water Mark (OHWM) of approximately 0.90 acre of one (1) open water pond, approximately 15.85 acres of twelve (12) wetland complexes, and convert approximately 1,513.1 linear feet of five (5) channelized streams into piped streams along R67 that flow into the Little Black River, in the borderline of section 15/16, 21/22, 27/28, and 33/34, T. 23 N., R. 5 E., south of Harvell on R67, Butler County, Missouri. This is a federally funded project through FHWA. Therefore, MoDOT is the designated non-federal lead agency for T&E and Section 106 determinations.
