  • SWL 2017-00028

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Missouri Conservation Heritage Foundation (MCHF), P.O. Box 366, Jefferson City, Missouri 65102-0366, proposes to establish Mitigation Plan No. SSTF1010-Christian County, entitled the Kipfer Project. The mitigation plan would be established under MCHF’s Stream Stewardship Trust Fund (SSTF) In-lieu Fee Instrument. A draft copy of the mitigation plan has been reviewed by the Interagency Review Team (IRT), which is made up of pertinent state and Federal resource agencies. The project site is on Bull Creek, in sections 5 and 8, T. 25 N., R. 20 W., Christian County, Missouri. The purposes of the project are to reduce bank erosion, improve channel stability, and protect the forested riparian corridor along Bull Creek. The mitigation project would directly address the resource threats for the Bull Creek Priority Watershed and the specific areas of concern for the White River Ecological Drainage Unit (EDU), such as minimizing sources of eroding soils, restoring and maintaining well-vegetated riparian areas, and restoring in-stream habitats to support aquatic life.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Don Thompson, R&D Holding, LLLP, 10715 Train Station Drive, Mabelvale, Arkansas 72103, has requested authorization for the placement of dredged and fill material in waters of the United States associated with a commercial development project. The proposed project is located in herbacaeus wetlands and an unnamed tributary of Otter Creek, in the SE 1/4 of section 9, T. 1 S., R. 13 W., Little Rock, Pulaski County, Arkansas. A jurisdictional man-made pond previously identified on the property has been mostly drained, and is now considered an ephemeral stream channel. The basic purpose of the project is to construct an industrial park that will house up to twenty businesses. The overall purpose of the project is to construct an industrial facility with attendant features including parking lots, access roads, and loading facilities that will service the commercial needs in this region.

  • 2017 NWP

    On January 6, 2017, the U.S. Army Corps of Engineers (Corps) published the notice in the Federal Register announcing the reissuance of all 50 existing nationwide permits (NWPs), general conditions, and definitions with some modifications. The Corps also issued two new NWPs, one new general condition, and five new definitions. The 2017 NWPs will go into effect on March 19, 2017, and will expire on March 18, 2022. With the publication of this Federal Register notice, Corps districts will begin finalizing their regional conditions for the new and reissued NWPs. Regional conditions will provide additional protection for the aquatic environment, and will help ensure that the NWPs authorize only those activities with no more than minimal adverse environmental effects. Regional conditions will help ensure protection of high value waters within the Little Rock District. The publication of this Federal Register notice also begins the 60-day period for states, Tribes, and the Environmental Protection Agency (EPA) to complete their water quality certification (WQC) processes for the NWPs. The 60-day period for WQC will end on March 6, 2017. This Federal Register notice also begins the 90-day period for coastal states to complete their Coastal Zone Management Act (CZMA) consistency determination processes. The 90-day period for CZMA consistency determinations will end on April 5, 2017.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Greg Jones, Woodlands Edge Communities Association, Inc., c/o Peak Properties, LLC, 11711 Hermitage Road, Suite 7, Little Rock, Arkansas 72211, has submitted their WEMB prospectus. The prospectus outlines the proposal for developing and operating the bank, which is known as the banking instrument. After public comments are received and any issues are resolved on the prospectus, Woodlands Edge Communities Association, Inc. will submit a draft banking instrument to the District Engineer of the Little Rock District. The District Engineer will then distribute the draft banking instrument to the Interagency Review Team (IRT), which is made up of the Corps and the pertinent state and Federal resource agencies. The IRT will review the banking instrument and coordinate with Woodlands Edge Communities Association, Inc. on any issues until a final banking instrument is completed. Finally, the District Engineer will review the final instrument and make a decision to approve or not approve. The primary purpose of this bank is to mitigate for unavoidable impacts to streams authorized under Section 404 of the Clean Water Act. The project goals are to preserve, enhance, and restore stream and associated riparian buffer functions and services within the mitigation bank area. The proposed project is located in Little Fourche Creek and associated tributaries and wetlands, in sections 7, 8, and 17, T. 1 N., R. 13 W., in Little Rock, Pulaski County, Arkansas.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Todd Witham, Maumelle Ridge 223, LLC, 5 Deauville Circle, Little Rock, Arkansas 72223, has requested authorization for the placement of dredged and fill material in waters of the United States associated with an 83-acre residential development project. The proposed project is located in unnamed tributaries of Palarm Creek, in section 29, T. 3 N., R. 13 W., Maumelle, Pulaski County, Arkansas. The basic purpose of the project is to construct a residential development. The overall purpose of the project is to develop the site to serve the housing needs for the City of Maumelle and Central Arkansas.
