    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Chris Thornton, Thornton Commercial Builders, 1855 McKennon Street, Suite 100, Conway, Arkansas 72032, has requested authorization for the placement of dredged and fill material in 6.2 acres of wetlands associated with the construction of an 11.5-acre assisted living facility with ancillary services for the residents of the assisted living village and the general public. These ancillary services may include, but are not limited to, a pharmacy, a restaurant, a salon, a small grocery/market, etc. The project site is located at 32 Bronnie Lane in Conway, Arkansas, and will provide access to Interstate 40 by way of Bronnie Lane. Mechanized land clearing, grading, and road construction will take place using suitable equipment (such as excavators, dump trucks, and bulldozers). The proposed project is located in wetlands associated with Stone Dam Creek that flows eastward into Lake Conway and then ultimately into Palarm Creek and the Arkansas River, in section 20, T. 5 N., R. 13 W., Faulkner County, Arkansas.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Dave Meghreblian, PotlatchDeltic Corporation, 7 Chenal Club Boulevard, Little Rock, Arkansas 72223, has requested authorization for the placement of dredged and fill material in waters of the United States (WOTUS) associated with the construction of a 122-acre single family residential development referred to as Chenal Valley – Phase 30 and 31. Mechanized land clearing, grading, storm water detention, road construction, and residential home construction will take place using suitable equipment (such as excavators, dump trucks, and bulldozers). The project would impact (fill, culvert, and impound) approximately 3,722 linear feet of jurisdictional ephemeral stream; 933 linear feet of jurisdictional intermittent stream; and 0.8 acres of a jurisdictional man-made wetland. Implementation of erosion and sediment controls at the site will minimize or eliminate water quality impacts, other than the planned fills, to receiving streams and wetlands, and will protect water quality in downstream waters. The proposed project is located in streams and an adjacent man-made wetland associated with several unnamed tributaries that flow into Little Maumelle River and ultimately the Arkansas River, in sections 24 and 25, T. 2 N., R. 14 W., Little Rock, Pulaski County, Arkansas.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that EGIS, Inc., 314 South Main, Bentonville, Arkansas 72712, has submitted their EGIS NWA Mitigation Bank prospectus. The prospectus outlines the proposal for developing and operating the bank, which is known as the banking instrument. After public comments are received and any issues are resolved on the prospectus, EGIS, Inc. will submit a draft banking instrument to the District Engineer of the Little Rock District. The District Engineer will then distribute the draft banking instrument to the Interagency Review Team (IRT), which is made up of the Corps and the pertinent state and Federal resource agencies. The IRT will review the banking instrument and coordinate with EGIS, Inc. on any issues until a final banking instrument is completed. Finally, the District Engineer will review the final instrument and make a decision to approve or not approve.

  • CLEAN WATER ACT FINAL RULE

    On September 12, 2019, the Environmental Protection Agency and Department of the Army (the agencies) signed a final rule to repeal the 2015 Clean Water Rule (2015 Rule) and re-codify the regulatory text defining "waters of the United States" (WOTUS) that existed prior to the 2015 Rule. This action will, when effective, provide regulatory certainty as to the definition of “waters of the United States” in light of ongoing litigation over the 2015 Rule. This final rule will be implemented in accordance with Supreme Court decisions, agency guidance, and longstanding practice.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that, Hogwild Development, LLC, Mattie Crossland-Haverkamp, P.O. Box 45, 833 S. East Avenue, Columbus, Kansas 66725, has requested an after-the-fact (ATF) permit authorization for the placement of dredged and fill material in waters of the United States (WOTUS) associated with the conversion of two existing industrial warehouse facilities to a professional commercial office complex and construction of two additional surface parking lot facilities that will accommodate the relocation of approximately 900 employees from a local corporate campus renovation. The single-and-complete project area consists of approximately 28 acres. Leveling and grading will be required and the proposed project will result in the placement of fill material below the plane of the ordinary high water mark (OHWM) in an intermittent stream (I-1), open water body (OW-1), and multiple wetlands (W-1, W-2 Isolated, W-3 Isolated, W-4, W-5, W-6) that are potentially directly or indirectly in support of an unnamed tributary of Osage Creek, in the NW 1/4 of section 8, T. 19 N., R. 30 W., Bentonville, Benton County, Arkansas.
