    On May 11, 2007, the Little Rock District Corps of Engineers issued a general permit for recreational facilities in navigable waters of the United States within the States of Arkansas and Missouri. As lead Corps District in the state, Little Rock District is responsible for coordinating advertisement and review of comments on this district-wide as well as statewide general permit. Little Rock, Vicksburg, and Memphis Districts are represented in the State. The authority for permit issuance is found in Section 10 of the Rivers and Harbors Act of 1899 (33 U.S. Code 403) and Section 404 of the Clean Water Act (33 U.S. Code 1344). Corps districts are authorized to develop general permits in accordance with Title 33, Code of Federal Regulations Parts 325.2(e)(2) and 325.5(c)(1).

    The Corps has finalized the Arkansas Regional Conditions (listed below) for the new and reissued NWPs. The regional conditions will also be effective on March 19, 2012. Regional conditions will provide additional protection for the aquatic environment, and will help ensure that the NWPs authorize only those activities with minimal adverse effects on the aquatic environment. The regional conditions will help ensure protection of high value waters within the State of Arkansas.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that the Grotto Springs Ranch LLC (Grotto) has submitted their completed Rattlesnake Creek Mitigation Bank prospectus. The prospectus outlines the proposal for developing and operating the bank which is known as the banking instrument. After public comments are received and any issues resolved on the prospectus, Grotto will submit a draft banking instrument to the District Engineer of the Little Rock District. The District Engineer will distribute the draft banking instrument to the Interagency Review Team (IRT), which is made up of the Corps and the pertinent state and Federal resource agencies. The IRT will review the banking instrument and coordinate with Grotto on any issues until a final banking instrument is completed. Finally, the District Engineer will review the final instrument and make a decision to approve or not approve.

    Pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S. Code 403) and Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Bryce Mobley, Mobley Construction Company, Inc., PO Box 620, Morrilton, Arkansas 72110 has requested an extension of an existing sand and gravel dredging permit. The proposed project is located in the Arkansas River, between Navigation Miles (NM) 149.5 and 153.5, 156.7 and 164.2, 165.6 and 176.3, 177.4 and 204.8, and 206.0 and 255.8, in Franklin, Logan, Johnson, Faulkner, Perry, Conway, Yell, and Pope Counties, in Arkansas. The proposed extension would be for five years, to December 31, 2017.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Wal-Mart Stores, Incorporated, 2001 SE 10th Street, Bentonville, Arkansas 72716 has requested authorization for the placement of dredged and fill material in waters of the United States associated with the construction of a levee to prevent flooding of the Alma store location. The proposed project is located in the SE 1/4 of section 6, T. 9 N., R. 30 W., Alma, Crawford County, Arkansas.
