    Pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S. Code 403) and Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Gavilon Group, LLC, Mr. Tom Lechtenberg, 11 ConAgra Drive, Omaha, Nebraska 68102 has requested authorization to install eight 48-inch-diameter dolphins, six 72-inch-diameter dolphins, a 60-foot by 60-foot sheet pile dock, unloading conveyor, a four-legged tower for a load-out conveyor, truss mechanism, loading spouts, and winching machinery. The project proposal includes the placement of dredged and fill material in waters of the United States associated with backfill material for the sheet pile dock and riprap associated with the base of the structures. The proposed project is located on the right descending bank of the Arkansas River, Navigation Mile 73.5, in Jefferson County, Arkansas.

  • MSMM 2012

    On March 30, 2007, the five U.S. Army Corps of Engineers (Corps) Districts in the State of Missouri adopted the MSMM. The MSMM was developed in response to agency comments for implementing a stream mitigation assessment method to adequately address compensatory mitigation for stream impacts and the need for a consistent standard to be used in all Corps Districts in the State of Missouri. The MSMM became the primary tool used for the evaluation of stream impacts and mitigation proposals for Department of the Army permit evaluations within the State of Missouri. The Missouri Department of Natural Resources also modified their State of Missouri Aquatic Resources Mitigation Guidelines to include the MSMM.

    On May 11, 2007, the Little Rock District Corps of Engineers issued a general permit for recreational facilities in navigable waters of the United States within the States of Arkansas and Missouri. As lead Corps District in the state, Little Rock District is responsible for coordinating advertisement and review of comments on this district-wide as well as statewide general permit. Little Rock, Vicksburg, and Memphis Districts are represented in the State. The authority for permit issuance is found in Section 10 of the Rivers and Harbors Act of 1899 (33 U.S. Code 403) and Section 404 of the Clean Water Act (33 U.S. Code 1344). Corps districts are authorized to develop general permits in accordance with Title 33, Code of Federal Regulations Parts 325.2(e)(2) and 325.5(c)(1).

    The Corps has finalized the Arkansas Regional Conditions (listed below) for the new and reissued NWPs. The regional conditions will also be effective on March 19, 2012. Regional conditions will provide additional protection for the aquatic environment, and will help ensure that the NWPs authorize only those activities with minimal adverse effects on the aquatic environment. The regional conditions will help ensure protection of high value waters within the State of Arkansas.

    Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that the Grotto Springs Ranch LLC (Grotto) has submitted their completed Rattlesnake Creek Mitigation Bank prospectus. The prospectus outlines the proposal for developing and operating the bank which is known as the banking instrument. After public comments are received and any issues resolved on the prospectus, Grotto will submit a draft banking instrument to the District Engineer of the Little Rock District. The District Engineer will distribute the draft banking instrument to the Interagency Review Team (IRT), which is made up of the Corps and the pertinent state and Federal resource agencies. The IRT will review the banking instrument and coordinate with Grotto on any issues until a final banking instrument is completed. Finally, the District Engineer will review the final instrument and make a decision to approve or not approve.
