The U.S. Army Corps of Engineers (Corps), Little Rock District, announces the
availability of the updated National Wetland Plant List (NWPL). The NWPL plays a
critical role in wetland determinations under the Clean Water Act and Food Security Act.
Wetlands are evaluated using three parameters – soils, hydrology and vegetation. Using
sampling protocols outlined in the Regional Supplements to the 1987 Wetland
Delineation Manual, the indicator status is then used to determine whether the vegetation
parameter is met.

On March 30, 2007, the five US Army Corps of Engineers (Corps) Districts in the State of Missouri adopted the Missouri Stream Mitigation Method (MSMM). The MSMM has now been modified to align the document with Corps and USEPA joint regulation for Compensatory Mitigation for Losses of Aquatic Resource; Final Rule dated April 10, 2008, national guidance, statewide policies, user comments, and Regulatory Project Manager experience. The MSMM is used by regulatory agency personnel and the public to quantify unavoidable stream impacts associated with the review of permit applications submitted for authorization under Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) and Section 404 of the Clean Water Act (33 USC 1344). Another key element of the MSMM is to serve as a tool for determining the amount of stream mitigation credits that a proposed project will generate based on the mitigation plan prepared for Stream Mitigation Banks, Individual In-Lieu Fee Stream Project Approvals, or Permittee-Responsible Mitigation Sites within the State of Missouri. The public notice comment period closes on April 26, 2012.

State of Arkansas Nationwide Permit Special Conditions. On May 11, 2007, the Little Rock District Corps of Engineers issued a general permit for recreational facilities in navigable waters of the United States within the States of Arkansas and Missouri. As lead Corps District in the state, Little Rock District is responsible for

conditions, and definitions with some modifications. The Corps also issued two new NWPs,

On March 1, 2011, the Little Rock District issued an initial public notice of the proposed
regional conditions to ensure activities authorized by the proposed NWPs result in no more than
minimal individual and cumulative adverse effects on the aquatic environment. Based on public
comments received and subsequent agency coordination, we have modified the initial version of
the regional conditions. Specifically, we have added two new regional conditions.

The overall purpose of the project is to restore a commercial dock to the condition that existed
prior to May 26, 2011, that was damaged due to high water, install a revetment and baffle dike to
reestablish the January 10, 2006, bank line and protect the parking area, install bank paving to
prevent erosion, and perform maintenance dredging to provide boat access from the marina to
the river during low flows.

The basic purpose is to provide compensatory mitigation for impacts to waters
of the United States. The overall purpose of the project is to develop and operate the 413.9-acre
GFWMB which would sell mitigation credits to entities that adversely impact wetlands
associated with Department of the Army, Section 10 and/or Section 404 permits. The stated
goals for the GFWMB are to re-establish the site as a sustainable bottomland hardwood
ecosystem by restoring wetland functions and values and a perpetual conservation of the

The U.S. Army Corps of Engineers, Memphis, Linle Rock, and Vicksburg Districts, District Engineers (DE) announce the issuance of a Regional General Permit (ROP) to authorize deposition of fill material into waters of the United States, as regulated by Section 404 of the Clean Water Act, associated with the relocation of agricultural drainage ditches in the state of Arkansas. This RGP authorizes the relocation of up to 3,000 linear feet of a previously constructed/channelized agricultural drainage ditch currently in use for establi shed fanning operations. This RGP is intended to provide a basic framework for landowners to accomplish the relocation and subsequent management of relocated agricultural ditches.

The basic purpose of the project is to sustain economic growth in the region by constructing a safe, cost-effective interstate grade highway. The overall purpose of the project is to provide one of the necessary components in the Interstate 69 linkage system. The proposed I-69 link from El Dorado to McGehee represents one section, known as Section of Independent Utility 13 (SIU 13), of the nationally designated I-69 corridor that extends from Port Huron, Michigan to the Texas/Mexico border. The SIU 13 project area is approximately 110 miles long and encompasses all or portions of Columbia, Ouachita, Union, Calhoun, Bradley, Ashley, Drew, Chicot and Desha Counties. In the early 1990’s, Congress and the Intermodal Surface Transportation Efficiency Act identified the I-69 corridor as a high-priority corridor. This project is not water dependent, but an extensive alternative analysis was completed as part of the environmental impact statement (EIS) titled, I-69 Section of Independent Utility 13 El Dorado to McGehee, Arkansas.

The prospectus, which is known as a banking instrument, outlines Swallow Tail, LLC’s proposal for developing and operating the bank. After public comments are received and any issues resolved on the prospectus, Swallow Tail, LLC will submit a draft banking instrument to the District Engineer of the Little Rock District. The District Engineer will distribute the draft banking instrument to the Interagency Review Team (IRT), which is made up of the Corps and the pertinent state and Federal resource agencies. The IRT will review the banking instrument and coordinate with Swallow Tail, LLC on any issues until a final banking instrument is completed. Finally, the District Engineer will review the final instrument and make a decision to approve or not approve.

The basic purpose of the project is to provide additional traffic capacity to serve current and projected traffic needs. The overall purpose of the project is to upgrade the State Highway 265 corridor. In the past fifteen years, northwest Arkansas has experienced unprecedented population growth. State Highway 265 is one of four continuous north-south roadways that serve both the commuter and commercial traffic in the Washington and Benton County region. On May 13, 2011, the U.S. Army Corps of Engineers published in the Federal Register, a proposal to authorize Natural Resources Conservation Service (NRCS) approved categorical exclusions for inclusion under Nationwide Permit 23 (NWP 23).

NWP 23 is used to authorize certain actions by other Federal agencies that are categorically excluded under the National Environmental Policy Act (NEPA), in accordance with 40 CFR Parts 1500 to 1508, because the action is included within a category of actions that have no more than minimal individual and cumulative adverse environmental effects.

In the early 1990’s, Congress and the Intermodal Surface Transportation Efficiency Act identified the U.S. Highway 71 corridor extending from Kansas City, Missouri to Shreveport, Louisiana as a high-priority corridor. Similar to the AHTD, the Missouri Department of Transportation has made a commitment to upgrade the existing U.S. Highway 71 to a freeway facility from the Arkansas/Missouri state line to Kansas City. The project is not water dependent, but an extensive alternative analysis was completed as part of the environmental impact statement (EIS).

The U.S. Army Corps of Engineers (USACE) announced today it is soliciting public comments on the updated draft National Wetland Plant List (NWPL) developed as part of an ongoing interagency effort to identify and assign wetland plant ratings (indicator status) to species found in the U.S and its territories. The NWPL provides a list of wetland plants by species and their wetland ratings that is used extensively by federal, state agencies, the scientific and academic communities, and the private sector in wetland delineations, the planning and monitoring of wetland mitigation and restoration sites, and serves to provide general botanical information about wetland plants.

The U.S. Army Corps of Engineers, Little Rock District, announces the availability of the Final Atlantic and Gulf Coastal Plain Regional Supplement to the 1987 Wetland Delineation Manual. This supplement was developed by regional expert delineators with input from state and Federal agencies, academia and other local experts. It was peer reviewed by a panel of independent scientists and field tested by interagency teams of state and Federal agencies to determine the clarity and ease of use of the document and whether its use will result in any spatial changes in wetland jurisdiction for Clean Water Act Section 404 purposes.
