SWL 1984-09051-GS - 11/26/2014: Consideration of reissuance of a regional general permit for the placement of dredged and fill material in waters of the United States associated with the construction of steps, walkways, or footbridges within the Little Rock District in the States of Arkansas and Missouri.

SWL 2014-00093 - 11/26/2014: Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that, Mr. Ryan Mosser, Collett Properties, 1111 Metropolitan Avenue #700, Charlotte, North Carolina 28204 & Mr. Michael Allan, Wal-Mart Real Estate Business Trust, 2001 SE 10th Street, Bentonville, Arkansas 72716, has requested authorization for the placement of dredged and fill material in waters of the United States associated with construction of a Sam’s Club and an approximately 400,000-square-foot retail center known as Lewis Crossing. The proposed project is located in an unnamed tributary of Lake Conway and associated tributaries and wetlands, in the SW 1/4 of section 20 and the NW 1/4 of section 17, T. 5 N., R. 13 W., Conway, Faulkner County, Arkansas.

SWL 2014-00448 - 11/25/2014: Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that the Arkansas Highway and Transportation Department (AHTD), PO Box 2261, Little Rock, Arkansas 72203, has requested authorization for the placement of dredged and fill material in waters of the United States associated with widening U.S. Highway 62 between Berryville and Green Forest. The proposed project begins approximately one mile east of Berryville and ends approximately one mile west of Green Forest in sections 34 and 35, T. 20 N., R. 24 W., and in sections 1, 2 and 3, T. 19 N., R. 24 W., and in section 6, T. 19 N., R. 23 W., Carroll County, Arkansas. Total length of the project is approximately 3.7 miles. The basic purpose of the project is to provide safe and efficient movement of traffic within the region. The overall purpose of the project is to upgrade the U.S. Highway 412/62 corridor across the northern segment of the state. The project is not water dependent, and an extensive alternative analysis was completed as part of the environmental impact statement (EIS).

SWL 2013-00357 - 11/5/2014: The Missouri Conservation Heritage Foundation-Stream Stewardship Trust Fund proposes to amend their existing In-Lieu (ILF) Fee instrument by including an additional service area. The Sponsor proposes to include the Grand/Chariton Ecological Drainage Unit (EDU) within the operational area for the ILF program. The proposed addition is based on the demand for mitigation credits within this service area.

CWA-PR Extension - 10/14/2014: On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation’s public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of “waters of the United States” protected under the Act. This notice is to announce that the comment period has been extended through November 14, 2014. The comment period has been extended in response to stakeholder requests and to allow comments on new supporting materials. The agencies expect to receive additional relevant materials from the Science Advisory Board prior to October 20, 2014, which will be placed on the docket as soon as they are available. We encourage interested parties to periodically check the docket for updates on these materials. The comment period which was originally scheduled to end on July 21, 2014, had been previously extended to October 20, 2014. Comments now must be received on or before November 14, 2014.
