SWL 2013-00041 - 6/17/2013: Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Southwestern Energy Company, 1000 Southwestern Energy Drive,Conway, Arkansas 72032 has submitted their Caney Creek Mitigation Bank (CCMB) prospectus. The prospectus outlines Streamworks Mitigation Service’s (SMS) proposal for developing and operating a single-user mitigation bank for Southwestern Energy Company (SWN) which is known as the banking instrument. After public comments are received and any issues are resolved on the prospectus, SMS will submit a draft banking instrument to the District Engineer of the Little Rock District. The District Engineer will then distribute the draft banking instrument to the Interagency Review team (IRT), which is comprised of the Corps, and pertinent state and Federal resource agencies. The IRT will review the banking instrument and coordinate with SMS on any issues until the banking instrument is completed. Finally, the District Engineer will review the final instrument and make a decision to approve or not approve. The entire process usually takes a minimum of seven months.

SWL 2012-00305 - 4/3/2013: Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that the City of Bentonville, 305 SW A Street, Bentonville, Arkansas 72712, has requested authorization for the placement of dredged and fill material in waters of the United States associated with the construction of a concrete-lined stream channel and the replacement of four bridges. The concrete-lined channel would be 2,525 feet in length. To construct the concrete-lined channel, approximately 6,000 cubic yards of material would be excavated from the existing stream. Approximately 530 cubic yards of material would be placed in the channel and in an adjacent 0.1-acre wetland. The existing four bridges would be replaced with four 32-foot-wide by 40-inch-tall precast concrete culverts. The proposed project is located in an unnamed tributary to Little Osage Creek, in sections 31 and 32, T. 19 N., R. 30 W., Bentonville, Benton County, Arkansas.

SWL 2012-00438 - 3/22/2013: Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that Mr. Kevin L. Steele, Steele Development, LLC, 620 McConnell,Joplin, Missouri 64801, has requested authorization for the placement of dredged and fill material in waters of the United States associated with construction of an approximately 130-acre mixed-use commercial development. The proposed project is located in Silver Creek and associated tributaries and wetlands, in section 24, T. 27 N., R. 33 W., Joplin, Newton County, Missouri.

SWL 2012-00089 - 3/14/2013: Pursuant to Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that, Mr. Jeremy Jansen Baltz, PO Box 20, Pocahontas, Arkansas 72455, has requested authorization for the placement of dredged and fill material in waters of the United States associated with the construction of a 90-acre lake behind a 60-foot-high dam. The dam will be designed in accordance with the Arkansas Natural Resources Commission Dam Safety Program. The dam will include provisions for minimum release, primary and emergency spillways, and drawdown. The dam footprint would place fill in approximately 360 linear feet of this perennial stream and inundate approximately 2,700 linear feet of perennial stream, 1,050 feet of intermittent stream, and 4,050 feet of unnamed ephemeral streams. The proposed embankment to construct the dam would require 250,000 cubic yards of material. The proposed project is located in Havy Branch, in the N½ of section 11, T. 21 N., R. 2 W., east of Elm Store, Randolph County, Arkansas.

SWL 03765-8 - 3/14/2013: Pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S. Code 403), notice is hereby given that Ronnie Duffield Gravel Company,16 Bluff Drive, Russellville, Arkansas 72802-7866,has requested a time extension of their existing permit to remove sand, gravel, and soil from dike fields along the Arkansas River. The proposed project is located on the left descending bank of the Arkansas River from Navigation Mile 200.0 to Navigation Mile 201.3, in section 3, T. 6 N., R. 20 W., in Pope County, Arkansas.
